1. Acceptance of These Terms

ShopHenCo Books is operated by ACME Home Services LLC (collectively, “ShopHenCo Books,” “we,” “us,” or “our”). These Terms of Service (“Terms”) apply to your use of ShopHenCoBooks.com (the “Site”), our content, and products or services offered directly through us.

By accessing or using the Site, submitting an inquiry, or purchasing or accessing a product, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site or our products.

2. Eligibility and Acceptable Site Use

You must be at least 18 years old, or the legal age of majority where you live, to make a purchase or enter into a binding transaction. If you use the Site on behalf of a business or organization, you represent that you have authority to bind it to these Terms.

You agree not to:

• Use the Site or our products for unlawful, fraudulent, or harmful activity.
• Interfere with, damage, overload, or attempt to bypass the Site’s security.
• Introduce malware, scrape the Site abusively, or use automated systems in a way that disrupts normal operation.
• Impersonate another person or provide false or misleading information.
• Copy, share, resell, publish, or commercially exploit protected content except as these Terms expressly allow.
• Use our content to violate another person’s rights or any applicable law.

3. Products and Services

ShopHenCo Books may offer or feature practical books by Mark Henning, downloadable DIY Fix-It Kits, checklists, articles, photography, original human-made artwork, prints, and related products or content. Some items are sold directly and others are offered by outside retailers, marketplaces, or payment providers.

We try to describe products accurately, but colors, proportions, and appearance may vary by screen or device. Measurements, condition descriptions, photographs, availability, edition information, prices, and other details should be reviewed before purchase. Minor typographical errors may be corrected.

We may limit quantities, decline or cancel an order, correct a listing, or discontinue a product when reasonably necessary. If we cancel an order that we processed and charged, we will issue an appropriate refund.

4. Orders, Prices and Payment

You agree to provide accurate, complete, and current order, contact, billing, and delivery information. An order is an offer to purchase and is not accepted until the seller confirms or fulfills it. For original artwork or other individually arranged sales, written confirmation of the item, price, payment method, delivery terms, and any special conditions may be required before the sale is final.

Prices are stated in U.S. dollars unless otherwise shown. Taxes, shipping, insurance, customs charges, or other disclosed costs may be added where applicable. Prices and offers may change before an order is accepted but will not be changed retroactively after acceptance.

Payments may be processed by third-party providers. Their terms and privacy practices apply to payment processing. ShopHenCo Books does not receive or store the complete payment-card number for transactions processed entirely by an outside provider.

5. Digital Products and Personal-Use License

Digital products are delivered electronically or made available through a download or access link. Delivery times and access instructions may depend on the platform used for checkout.

When you lawfully purchase a digital Fix-It Kit, eBook, checklist, or other download from us, you receive a limited, nonexclusive, nontransferable, revocable license to download and use it for your own personal, noncommercial purposes. You may print a reasonable number of copies for your own household use.

You may not, without prior written permission:

• Resell, sublicense, rent, upload, distribute, or publicly post the digital product.
• Share access links or files outside your household.
• Remove copyright, trademark, attribution, or rights notices.
• Modify or repackage the product for sale, training, publication, or other commercial use.
• Use the product to build or supply a competing product or content library.

Buying a digital product does not transfer ownership of its intellectual property. The license ends if you materially violate these Terms.

6. Physical Products, Books and Original Artwork

Physical books purchased through an outside retailer are shipped and fulfilled under that retailer’s policies. For products we sell or arrange directly, estimated shipping or delivery information is not a guarantee unless we expressly agree otherwise in writing.

Original artwork is often unique, pre-owned, vintage, or sold in its existing condition. Natural aging, frame wear, surface variation, prior restoration, or other condition details may be shown or described in the listing or purchase correspondence. Please review all available photographs, measurements, provenance information, and condition notes and ask questions before purchasing.

Shipping, insurance, local pickup, delivery, inspection, and return terms for an original artwork may be confirmed in writing before payment. A sale-specific written agreement or checkout disclosure controls if it differs from this general section.

7. Refunds, Returns and Cancellations

Digital products

Because digital products cannot be physically returned, digital sales are generally final after the file, download link, or access has been delivered. This does not limit any refund, replacement, or cancellation right required by applicable law or provided by the selling platform. If a file is defective, duplicated, or inaccessible, contact us and we will make a reasonable effort to correct the problem.

Physical products sold directly by us

Unless a product listing or written sale agreement states different terms, contact us within 14 days after delivery to request a return. The item must be unused and returned in its original condition and packaging. You are responsible for return shipping unless the item was materially different from the agreed description, arrived damaged, or applicable law requires otherwise. Do not send a return before receiving return instructions.

Outside sellers

Returns, refunds, cancellations, and delivery issues for purchases made through Amazon, Barnes & Noble, Gumroad, or another outside seller must be handled under that seller’s policies and procedures.

8. DIY, Repair and Informational Disclaimer

Our books, Fix-It Kits, articles, checklists, and other materials are provided for general educational and informational purposes. They are not a substitute for an on-site inspection, manufacturer instructions, building codes, permits, or advice from a qualified contractor, electrician, plumber, engineer, attorney, medical professional, or other licensed professional.

Conditions differ from property to property. Before starting work, you are responsible for evaluating the task, using appropriate personal protective equipment, following product warnings, locating utilities, confirming permits and code requirements, and deciding whether the work should be performed by a licensed professional.

You choose whether and how to use the information and remain responsible for your work, safety, tools, property, legal compliance, and results.

9. Intellectual Property

Unless otherwise stated, the Site and its text, designs, graphics, logos, photographs, artwork images, product descriptions, books, downloads, and other content are owned by or licensed to ShopHenCo Books and are protected by copyright, trademark, and other laws.

You may view the Site and share ordinary links to publicly available pages. No other right or license is granted except the limited personal-use license expressly provided for a purchased digital product. Written permission is required for reproduction, republication, distribution, commercial display, derivative works, or commercial use.

Purchase of an original artwork transfers ownership of the physical object only. Copyright, reproduction, publication, licensing, and other intellectual-property rights do not transfer unless expressly assigned in a separate signed writing by the rights holder.

10. Communications and Submissions

When you contact us, you represent that the information you provide is accurate and that you have the right to provide it. You may not submit unlawful, threatening, infringing, malicious, or deceptive material.

Questions, reviews, suggestions, or other feedback may be used to respond to you, provide support, improve our products, or operate the business. We will not claim ownership of your original creative work merely because you send it to us. Do not send confidential business ideas, unpublished manuscripts, or sensitive personal information unless we have agreed in writing to receive them.

If you subscribe to promotional email, you may unsubscribe using the link in the message. Transactional or service-related messages may still be sent when reasonably necessary.

11. Third-Party Services and Affiliate Links

The Site may link to Amazon, Barnes & Noble, Gumroad, Pinterest, social-media platforms, service providers, suggested products, or other outside websites. A link does not mean that we control or guarantee the outside service. Your use of it is governed by its own terms, policies, pricing, availability, and privacy practices.

Some links may be affiliate links. If you click one or make a qualifying purchase, ShopHenCo Books may receive a commission, generally at no additional cost to you. Affiliate relationships do not change our goal of providing practical, relevant recommendations.

12. Availability and Changes to the Site

We may update, suspend, withdraw, or discontinue any part of the Site, content, or product offering at any time. We do not guarantee that the Site, a download, or every feature will always be available, uninterrupted, secure, or error-free. We may perform maintenance and may correct errors or broken links when found.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” ShopHenCo Books disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and any warranties arising from course of dealing or usage of trade.

We do not promise that information will be complete, current, suitable for every property or situation, or that following it will produce a particular result. Product warranties expressly provided by a manufacturer or outside seller, if any, remain subject to that provider’s terms. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, ShopHenCo Books, ACME Home Services LLC, and their owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, or business opportunities; or property damage or personal injury arising from misuse of the Site or informational materials.

To the fullest extent permitted by law, our total liability for a claim relating to a product or transaction will not exceed the greater of $100 or the amount you paid directly to us for the product or transaction giving rise to the claim during the 12 months before the event.

These limits do not apply where prohibited by law or to liability that cannot legally be limited. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some provisions may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ShopHenCo Books, ACME Home Services LLC, and their owners, officers, employees, contractors, and agents from third-party claims, liabilities, losses, and reasonable costs arising from your unlawful use of the Site or products, your material violation of these Terms, or your infringement of another person’s rights. This section does not require you to indemnify any party for its own unlawful conduct.

16. Suspension and Termination

We may restrict or terminate access to the Site or a digital product if we reasonably believe you have materially violated these Terms, misused the Site, infringed intellectual-property rights, committed fraud, or created a security or legal risk. Provisions that by their nature should survive termination—including ownership, license restrictions, disclaimers, liability limits, dispute terms, and payment obligations—will survive.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where the law of your jurisdiction must apply and cannot be waived.

Before filing a legal claim, you and ShopHenCo Books agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution to the email address below. If the dispute is not resolved within 30 days, either party may pursue available legal remedies.

Unless applicable law requires otherwise, any court proceeding relating to these Terms must be brought in a state or federal court with jurisdiction in Clark County, Nevada, and each party consents to that location and jurisdiction.

18. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with a new effective date. Changes apply going forward when posted and do not retroactively change an accepted order unless the parties agree or the law requires otherwise. Your continued use of the Site after revised Terms take effect means you accept them.

19. General Terms

These Terms, the Privacy Policy, and any product-specific terms or written sale agreement form the entire agreement between you and us for the subject they cover. If product-specific terms conflict with these general Terms, the product-specific terms control for that transaction.

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, financing, or sale of the business or its assets.

We are not responsible for delay or failure caused by events reasonably beyond our control, including carrier delays, natural disasters, utility or internet outages, labor disruptions, government actions, or failures of outside platforms.
